Welcome to Appster. These Terms & Conditions (“Terms”) govern your access to and use of our website, platforms, mobile applications, services, and any related products offered by Appster Digital (“Appster”, “we”, “us”, or “our”).
By accessing or using our website or services, you agree to these Terms. If you do not agree, please do not use our services.
1. Definitions
- “Client”, “User”, “You” refers to any individual or business using our website or services.
- “Services” refers to all digital services provided by Appster including software development, mobile apps, SaaS products, marketing, design, automation, maintenance, hosting, and consulting.
- “Agreement” refers to these Terms & Conditions along with any project contract, proposal, invoice, or scope of work mutually signed.
2. Acceptance of Terms
By using our website or engaging Appster for any service, you confirm:
- You are legally capable of entering a binding agreement.
- All information you provide is accurate and complete.
- You will comply with local laws and regulations in the UAE/GCC or in your respective region.
3. Services We Provide
Appster offers a wide range of digital services, including but not limited to:
- Custom Software & Mobile App Development
- SaaS Products & Digital Platforms
- UI/UX Design & Branding
- Cloud Hosting & Maintenance
- E-commerce Development
- API Integrations
- Digital Marketing & Automation
- Consulting and Technical Audits
Each service is governed by a separate proposal/SOW and contract signed between Appster and the client.
4. Intellectual Property
Unless otherwise agreed in writing:
- All code, designs, UI/UX, content, strategies, and digital assets created by Appster remain our intellectual property until full payment is received.
- After complete project settlement, ownership of the final deliverables transfers to the client only for the scope defined in the contract.
- Appster retains the right to showcase non-confidential work in portfolios, case studies, or marketing materials.
5. Client Responsibilities
Clients agree to:
- Provide timely access to information, content, approvals, and feedback necessary for project execution.
- Ensure all materials shared with Appster (logos, images, APIs, credentials, etc.) are legally owned or licensed.
- Maintain confidentiality of their own login credentials or admin access.
Failure to provide timely feedback or assets may result in project delays and rescheduling.
6. Payments & Fees
- All invoices issued by Appster must be paid according to the payment schedule in the proposal or contract.
- Late payments may result in project delays, suspension of work, or additional administrative fees.
- No code, files, or final deliverables will be released until full payment is received.
- All prices are exclusive of VAT unless stated otherwise.
7. Refunds & Cancellations
Appster does not offer refunds for services already initiated, delivered, or partially completed.
If a project is cancelled by the client:
- Payments already made are non-refundable, and
- Any remaining invoices for completed milestones become due immediately.
8. Revisions & Change Requests
Revisions are limited as per the agreed scope of work. Requests outside the agreed scope will be treated as Change Requests (CRs) and will be quoted separately.
9. Third-Party Tools & Integration
Some services may require third-party tools, plugins, hosting, APIs, payment gateways, or platforms (e.g., AWS, Azure, Google APIs, payment gateways, etc.). Appster is not responsible for:
- Third-party downtime
- Pricing changes
- API limitations
- Service restrictions
Any third-party cost will be borne by the client.
10. Data Privacy & Security
Appster follows industry-standard security practices. We ensure:
- Confidential handling of client data
- Restricted access to sensitive information
- Compliance with UAE, GCC, and international data standards where applicable
Clients are responsible for maintaining the security of their own accounts, servers, and access credentials. For more details, refer to our Privacy Policy.
11. Limitation of Liability
To the maximum extent permitted by law:
- Appster is not liable for any indirect, incidental, or consequential damages including loss of revenue, data, or business opportunities.
- Our total liability for any claim is limited to the amount paid by the client for the concerned service.
12. Service Availability
While we strive for uninterrupted services:
- We do not guarantee 100% uptime.
- Scheduled maintenance, upgrades, or unavoidable outages may occur.
- For hosting-related issues, timelines may depend on third-party providers.
13. Termination
Appster may suspend or terminate your access if:
- Payments are overdue
- There is misuse of our platform/servers
- You violate any clause of these Terms
- Illegal activities are suspected
Upon termination, all pending invoices become due immediately.
14. Confidentiality
Both parties agree to keep all business information, strategies, designs, code, and internal communications confidential unless legally required.
15. Governing Law
These Terms are governed by:
- The laws of the United Arab Emirates
- The respective emirate where the project contract is executed (e.g., Dubai, Sharjah)
Any disputes will be settled in the courts of the applicable emirate.
16. Amendments
Appster reserves the right to update or modify these Terms at any time. Changes will be posted on this page with a revised “Last Updated” date.
